1. About This Website
This website is owned and operated by Sensei Sheryn Gung (ABN: 22 798 551 778), trading as Sheryn Gung and Tanden Martial and Healing Arts. References to 'we', 'us', 'our', or 'Sheryn Gung', husband and martial arts instructor, 'Ross McDonald', 'Tanden Martial Arts' or 'Tanden Martial and Healing Arts' refer to this business entity. Our services include Transformational Self-Defence and Martial Arts (TSDMA) training, women's empowerment coaching, Traditional East Asian Medicine (TEAM) consultations, and digital educational programs including the hybrid Warrior Emerging Signature Program.

2. Use of This Website
By accessing this website, you warrant that you are at least 18 years of age, or that you have the consent of a parent or legal guardian. You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the website.
We reserve the right to restrict or terminate your access to the website and any products purchased at www.tanden.com.au  at our discretion, without notice, if you breach these Terms.

3. Programs, Services, and Enrolment
3.1 Service Description
Sheryn Gung offers transformational programs and services integrating martial arts, self-defence, somatic and energetic work, Traditional East Asian Medicine, and women's empowerment. Services include but are not limited to:
• The Warrior Emerging Signature Program (1:1, 1:2 and Group)
• The Warrior Awakening Workshop
• The Warrior Within Talk
• The Warrior Sister Collective Masterclass
• Individual TSDMA coaching and TEAM consultations, including Artisanal Shiatsu
• Digital educational products
 With your explicit consent, Ross McDonald may be present at some TSDMA/Warrior Emerging sessions, workshops and masterclasses for the purpose of educational advancement and realistic self-defence training.

3.2 Warrior Emerging Signature Program
The Warrior Emerging Program is a four-month transformational self-defence, martial arts, and empowerment experience delivered under the TSDMA methodology. We operate from our core values of Making a Difference, Excellence, Integrity, Commitment, and Courage, and bring expertise, care, dedication, and presence to every session.

Standard program inclusions are:
• 8 x 60-minute custom 1:1 Warrior Emerging Sessions (or 1:2 sessions for Teams of Two), completed within four months and typically scheduled fortnightly. Sessions may be conducted in person at the Tanden Dojo or via Microsoft Teams.
• Comprehensive Warrior Emerging Online Course with lifetime access (completion within four months is recommended).
• High-touch personal support and mentoring via private WhatsApp chat or email throughout the four-month program period (or a private WhatsApp group for Teams of Two). Responses are provided within 24 business hours.
• Bonus 'Warrior Sister' Support Package for graduates, comprising 4 x Private WhatsApp Monthly Check-Ins and an in-person Warrior Sister Collective VIP Half-Day Masterclass.
• Commitment Bonus: 2 x 75-minute Artisanal Shiatsu and Oriental Therapies treatments OR 2 x 60-minute 'Warrior Revealed' Empowerment Coaching sessions are offered for upfront payments.

3.3 Program Extensions
If life circumstances require a longer timeframe, 1:1 clients may be eligible for a program extension of up to 12 months, subject to agreement with Sheryn Gung. The following conditions apply during an extension period:
• 8 x 60-minute 1:1 sessions are distributed across the agreed extended timeframe.
• The Warrior Emerging Online Course may be completed at your own pace.
• WhatsApp mentoring and support is offered at a maximum of one thread per week.
• Bonus Warrior Sister Support Package elements are honoured upon program completion.
• Commitment Bonus sessions are honoured as agreed: one session at commencement and one upon completion.
Please note: program extensions are available to 1:1 clients only and are not available for Teams of Two. In the rare event that the extension arrangement is exploited, this agreement may be terminated and any remaining sessions and bonuses forfeited.

3.4 Teams of Two
The Warrior Emerging Program is available as a shared 1:2 experience for two participants. Both participants are bound individually by these Terms and Conditions. If one participant cannot attend a scheduled session, rescheduling is preferred so both may attend together. If rescheduling is not possible, the session will proceed as a 1:1 and the absent participant forfeits that session. Program components are non-transferable between participants.

3.5 Not Medical or Therapeutic Advice
The content, programs, and services offered through this website are for educational and personal development purposes only. They do not constitute medical, psychological, or therapeutic advice, diagnosis, or treatment. Traditional East Asian Medicine (TEAM) services, such as Artisanal Shiatsu Treatments, are provided as a complementary health modality and are not a substitute for advice from a registered medical practitioner. You should always seek the advice of your physician or qualified health provider before beginning any new health or fitness program, particularly if you have an existing physical or mental health condition.

3.6 Results Disclaimer
Testimonials and examples shared on this website reflect the personal experiences of individual clients and are not a guarantee of results. Your outcomes will depend upon your own effort, engagement, life circumstances, and other factors beyond our control. We make no guarantee of specific results from participation in any program or service.

4. Payment and Pricing
All prices displayed on this website are in Australian Dollars (AUD) and are inclusive of GST where applicable. Prices are subject to change without notice.
For the Warrior Emerging Signature Program, you may choose between:
• Upfront Payment in full (which includes the Commitment Bonus of 2 x Artisanal Shiatsu Treatments OR 2 x Warrior Revealed Empowerment Coaching sessions), or
• Instalment payments, as per the agreed payment schedule provided at the time of enrolment.
For all other services and digital products, payment is required in full at the time of purchase unless a payment plan has been expressly agreed upon in writing. We accept payment via the methods listed at the point of sale, ie: cash, bank transfer or Stripe. You are responsible for ensuring your payment details are accurate and that sufficient funds are available.

5. Satisfaction Guarantee and Cancellation Policy
5.1 Payments are Final, but there is a 100% Satisfaction Guarantee for Warrior Emerging
All payments for the Warrior Awakening Workshop, Warrior Within Talk and Warrior Emerging Signature Program are non-refundable. Significant time, energy, and care have been dedicated to the creation and delivery of the offers. Note that for the Warrior Emerging Signature Program, the commitment begins from the moment of enrolment.
We stand behind the transformational promise of  the Warrior Emerging Signature Program. Should unforeseen circumstances arise, or should you not experience the holistic empowerment transformation the program is designed to deliver, we will make every reasonable effort to support you in reaching your empowerment goals. This may include continuing to work with Sheryn Gung until the intended transformation takes place. Each situation is individually and compassionately assessed to determine a recommended and amicable resolution.

5.2 Session Cancellation and Rescheduling
No refunds will be issued due to cancellation of, or failure to attend, a scheduled session.
A minimum of 48 hours' notice is required to reschedule a 1:1 or 1:2 session. Sessions cancelled or missed without 48 hours' notice are forfeited. In the event that we need to cancel a session, we will provide as much notice as possible and will offer a full reschedule.
For Teams of Two: if one participant cannot attend and rescheduling is not possible, the session will proceed as a 1:1, and the absent participant forfeits that session.

5.3 Digital Products
Due to the nature of digital products and immediate access upon delivery, all sales of digital products, recordings, and downloadable content are final and non-refundable, except as required by Australian Consumer Law.

5.4 Non-Transferability
Unless otherwise agreed in writing, all program components, sessions, and bonuses are personal to the enrolled participant and are non-transferable to another person.

5.5 Australian Consumer Law
Nothing in these Terms limits or excludes your rights under the Australian Consumer Law. If a service has a major failure, you are entitled to cancel and receive a refund. If the failure is minor, we may repair, replace, or re-supply the service.

7. Intellectual Property
All content on this website - including text, images, video, audio, graphics, course materials, program frameworks, and the TSDMA methodology - is the intellectual property of Sheryn Gung and is protected by Australian and international copyright law. Stock content is obtained from pixabay.com. 
You may not reproduce, distribute, modify, adapt, transmit, display, publish, or otherwise exploit any content from this website without our express written permission. Sharing purchased materials outside the intended context of personal use is strictly prohibited.
Program participants are granted a limited, non-exclusive, non-transferable licence to access and use course materials solely for their personal, non-commercial development during their enrolment period.

8. Confidentiality and Community Standards
Where our offers involve group participation, all members are required to maintain confidentiality regarding the personal experiences and sharing of other participants. Information shared within group containers is not to be repeated, shared on social media, or discussed outside the group without the explicit consent of the person who shared it.
We reserve the right to remove any participant from a program who, in our sole discretion, engages in behaviour that is disruptive, disrespectful, or harmful to the safety of the group or the integrity of the offer. No refund will be issued in such circumstances.

9. Participant Responsibility and Health Acknowledgement
By enrolling or booking in any service, you confirm that:
• You are physically and mentally fit to participate in martial arts, self-defence, shiatsu, oriental therapies, and empowerment coaching as applicable.
• You will seek medical clearance prior to commencement if you have any health concerns or existing conditions.
• You take full responsibility for your wellbeing throughout the program.
• You agree to follow all safety instructions and act with care towards yourself and others.
• You acknowledge that martial arts and self-defence training carry inherent risks of physical injury.

10. Liability Waiver and Limitation of Liability
By engaging with our services, you acknowledge and agree that:
• Participation in any program or service is entirely at your own risk.
• You release and hold harmless Sheryn Gung, Warrior Emerging, Tanden Martial and Healing Arts, and any associated staff or contractors (including Ross McDonald for enhanced education and practical self-defence integration where applicable) from all liability for injuries, accidents, losses, damages, or psychological effects arising from your participation.
• This release extends to, but is not limited to, martial arts and self-defence activities, empowerment coaching and personal development, and TEAM, including Artisanal Shiatsu Treatments.
• To the maximum extent permitted by law, Sheryn Gung shall not be liable for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of this website or participation in any program or service, including but not limited to physical injury, loss of earnings, or emotional or psychological distress.
Our total liability to you for any claim arising under these Terms will not exceed the total amount paid by you for the relevant service or product. This limitation applies whether the claim arises in contract, tort, or otherwise.

11. Privacy
We are committed to protecting your personal information. Our Privacy Policy, which is incorporated into these Terms by reference, sets out how we collect, use, store, and disclose your personal information in accordance with the Privacy Act 1988 (Cth).
By using this website and engaging our services, you consent to the collection and use of your personal information as described in our Privacy Policy.
